Waste (England and Wales) Regulations to be revised
Judicial Review Process Averted

The Department for the Environment, Food and Rural Affairs has announced its intention to revise the regulations which transposed the revised Waste Framework Directive earlier this year, following a judicial review brought forward by seven members forming the Campaign for Real Recycling. The Judicial Review was initiated over the department’s interpretation of separated recycling and was due to occur on December 13th in Cardiff, however shall now not take place. The change in stance could affect the collection of recyclates, meaning that they may no longer be able to be collected via co-mingled schemes. However, the department’s press release ensures that multi-bin recycling systems will not be imposed on residents. Since being informed by new draft EU guidance and the Judicial Review process, the department will seek the views of industry, local authorities and interested parties to inform changes to the legislation created in March.
